Decree herein so long as Applicant desires to maintain the conditional appropriative <br />right of exchange herein awarded, or until a determination has been made that such <br />conditional appropriative right of exchange is made absolute by reason of completion of <br />the appropriation. <br />35. It is further ordered that in the event ground water is exposed, said pond <br />shall be backfilled so as not to expose groundwater until such time as either a well <br />permit has been obtained pursuant to C.R.S. § 37-90-137 and the storage rights have <br />been cancelled, or the pond is lined in accordance with the State Engineer's Guidelines <br />dated August 1999.
