augmentation will be owed because releases exceeded inflow during that <br />month. <br />The monthly out-of-priority storage will necessarily be variable from month <br />to month. However, monthly depletions are not expected to exceed those <br />displayed in column (D) of Table No. 4. To ensure injury does not occur to <br />downstream water right holders, replacements equivalent to those <br />displayed in column (E) of Table No. 4 will be made each month. The <br />monthly accounting will serve as a check to ensure that the actual <br />replacement requirement did not exceed the replacements made in any <br />given month. If the replacement requirement did exceed the replacements <br />made, the difference will be released with the next month's replacements. <br />d. Calls By Senior Water Rights: Senior water rights between the <br />Dawson Gulch Spring Pond and the confluence of the Colorado River and Muddy <br />Creek may also place a call for the water, at which point the Applicant's <br />augmentation source will not provide replacement water in the correct location to <br />prevent injury. In such a case, the Applicant shall cease storing additional water <br />within the pond, as such water would be stored out-of-priority and could not be <br />replaced in the correct location to prevent injury to the senior calling right. <br />Out-of-priority storage will be prevented by performing a daily water balance <br />accounting on the pond while the call is active. The accounting will ensure that <br />the storage in the pond, as calculating using (eq 5) above, is less than or equal to <br />zero each day until the call is revoked. Releases from the outlet will be made as <br />needed to ensure that the daily storage is less than or equal to zero. When <br />releases from the outlet can no longer be made due to the water level dropping <br />below the active storage level, the Applicant shall pump water out of the pond <br />and into Dawson Gulch until the level of the pond drops to the level <br />corresponding to zero storage for the day. The Applicant may use the two <br />permanently mounted pumps near the pond for this purpose. This daily <br />accounting will continue until the local call is revoked, after which the Applicant <br />may again store water in-priority or by exchange. <br />e. Iniury To Vested Water Rights: If the augmentation plan is operated <br />as described above, there will be no injury to other vested water rights. <br />C. APPROPRIATIVE RIGHTS OF EXCHANGE <br />19. Appropriative rights of exchange: Applicant shall have appropriative rights <br />of exchange to replace the out-of-priority depletions from the water rights described <br />herein by releases from Wolford Mountain Reservoir. <br />a.
