9. Date of initiation of appropriation: December 27, 2007 by filing <br />application. <br />10. Amount Claimed: 3 acre-feet, absolute, with the right to fill and refill in <br />priority or by exchange. <br />a. Active Storage = 1.0 acre-foot. This volume can be released by <br />gravity using an outlet located near the northern abutment of the dam. <br />b. Dead Storage = 2.0 acre-feet. This volume can be pumped out of <br />the pond using one or both of the pumps currently located at the pond. <br />11. Use: Applicant will store water in the Dawson Gulch Spring Pond for <br />subsequent irrigation, industrial, recreation, fishery, fire suppression, and stock watering <br />use. <br />a. Stored water to be used to irrigate two areas totaling approximately <br />0.42 acres located in Section 36, Township 1 North, Range 79 West of the 6th <br />P.M. as shown on Figure No. 2 attached hereto. <br />b. Stored water to be used for gravel washing purposes at the nearby <br />Parshall Gravel Pit, located in the SW 1/4 of the NW 1/4 of Section 31, Township 1 <br />North, Range 78 West of the 6th P.M as shown on Figure No. 3 attached hereto. <br />C. Stored water to be used for recreation, fishery, fire suppression, <br />and stock watering use at the location of the pond. <br />12. Dam height: Approximately 9 feet. <br />13. Dam length: Approximately 180 feet. <br />14. Surface Area: Approximately 0.62 acres at maximum capacity. <br />15. Remarks: The pond was surveyed on March 28, 2008. Exhibit A contains <br />a Pond Exhibit, a Plan & Profile Exhibit Map, and an area-capacity table generated from <br />that survey. <br />B. PLAN FOR AUGMENTATION <br />With respect to the claim for approval of a plan for augmentation set forth in the <br />Application, the Court makes the following findings based on the evidence and <br />documents presented by the Applicant: <br />16.
