Boyd <br />District Court Judge <br />Date of Order attached <br />A COURT USE ONLY A <br />Case No.: 2007CW234 <br />Division No. 5 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, RULING, <br />JUDGMENT AND DECREE <br />THIS MATTER comes before the Court on an Application For Storage Water <br />Right and for approval of a Plan for Augmentation With Appropriative Right of Exchange <br />("Application") filed by Loch-N-Vale Ltd. Liability Co., a Colorado limited liability <br />company, ("Applicant"), on December 27, 2007. <br />Prior to this decree, the Water Referee made such investigations as were <br />necessary to determine whether or not the statements in the Application were true, and <br />consulted with the Division Engineer, and became fully advised with respect to the <br />subject matter of the Application in accordance with § 37-92-302(4), C.R.S.; and the <br />Referee thereafter issued certain findings of fact, conclusions of law, and ruling <br />("Referee's Ruling") in this matter on August 26, 2009. <br />Applicant filed a Pleading: In Protest To Referee's Ruling ("Protest") on <br />September 11, 2009 asserting the need to correct certain typographical errors in <br />Paragraph 10a of the Referee's Ruling (see Paragraph 2a of Protest), and asserting the <br />need to add language which would expand the water storage right (see Paragraph 2b of <br />Protest), and the need to formally add a provision ordered by the Referee (see <br />Paragraph 2c of Protest). This decree corrects the typographical errors in Paragraph <br />10a of the Referee's Ruling, and incorporates the language ordered by the Referee on <br />page 14 of the Referee's Ruling into Paragraph 35 hereof. The request to expand the <br />water storage right sought in Paragraph 2b of the Protest is denied. <br />1. INTRODUCTION <br />Applicant is the owner of land located in Grand County, Colorado, in the NE 1/4 of <br />the SE 1/4 of Section 36, Township 1 North, Range 79 West of the 6th P.M. at a point 360 <br />feet west of the east section line and 2,520 feet north of the south section line of said <br />Section.
