Box 550 <br />10495 E. 120th Ave. <br />Henderson, CO 80640-0550 <br />303-659-6125 <br />RECEIVED <br />JAM, 2 8; 2003 <br />303-287-8240 <br />Division of Minerals and GtOb f. <br />Additional Comments: <br />We don't believe the French Drain proposed by 120`' Estates Partners is the solution to prevent <br />our shallow irrigation well from going dry or having a very diminished pumping rate when the <br />soil-bentonite slurry wall is in place. It is Central Colorado Water Conservancy District <br />augmented well permit number 12992, case number W-5311, location SE SE 34 01S 67W which <br />pumps 500 gallons per minute. A French Drain needs maintenance. Les Ewegen wants to install <br />it, then never have any future obligation. We don't think enough water would be collected by the <br />French Drain for us to pump into a 5 inch pipe under pressure to operate a rolling sprinkler with <br />26 sprinkler heads as our irrigation well does now. This well is 139 feet from the property line. <br />We also question whether the $10,000.00 escrow account proposed by 120th Estates Partners will <br />be sufficient to cover the costs of an acceptable solution such as a deeper well or a new well <br />in an acceptable location. We have retained hydrologist Benjamin P. Doty P.E. to provide <br />expert information in this matter. You can expect to receive a letter from him. <br />A second matter is 120' Estates Partners desire to mine to ten feet from our common property <br />line. Adams County requires mining be at least 125 feet from a residence. Ten feet from the <br />property line would put the gravel mine closer to our residence which is 59 feet from the property <br />line. The solution is to mine no closer than 125 feet from our home or 66 feet from the <br />property line. <br />When mining is done and reclamation complete a six foot county approved fence with three <br />strands of barbed wire above it must surround the water storage lake. If the resulting lake has an <br />undertow, preventing recreational use in addition to water storage makes sense, but reduces our <br />property value. Possible solutions are reclamation without undertow so the lake is: 1. An <br />attractive multi use amenity for recreational use by all property owners impacted for five years by <br />the noise, dust, truck traffic, and impaired wells. 120" Estates Partners should try to increase our <br />property values instead of diminishing them. Zoning of our property is RE, a classification <br />intended to upgrade the area. 2.
