16. The Forest Service reserves the right to suspend operations during periods of high fire <br />potential. <br />17. Unauthorized off-road vehicle travel is prohibited. <br />18. Drilling equipment (except for personnel conveyance) will not be mobilized on or off the <br />CEL area during the two days prior, on opening day, or on weekends during the first two rifle <br />hunting seasons. <br />19. The Licensee shall provide for suppression and control of fugitive dust on roads used by the <br />Licensee or its contractors. <br />20. The Licensee will be required to buck and stack merchantable timber removed during <br />construction operations in a publicly accessible location. Any slash generated from tree <br />removal operations shall be lopped and scattered to a maximum depth of 2 feet. <br />21. The road surface width will not exceed 14 feet, except in locations which require curve <br />widening. These locations must be identified on the ground and approved by the District <br />Ranger. <br />22. The Licensee and/or their contractors must have the necessary materials on hand and <br />immediately available to contain any spills of fuels, oil, and other contaminants. Any spills <br />must be reported to the USFS immediately. Immediate containment and clean-up will be <br />. required consistent with the Licensee's Spill Prevention, Control, and Countermeasures <br />(SPCC) Plan. Any contaminated soil will be removed from the Forest prior to reclamation. <br />In addition the following Conservation Measures, as prescribed by the US Fish & Wildlife <br />Service (USFWS), will apply to the activities proposed under COC-74235 <br />• Road construction guidelines, discussed on page 2 of the USFWS concurrence letter, <br />dated Sept 22, 2009, are to be implemented when reconditioning and reconstructing <br />roads. <br />• Sedimentation control measures, discussed on page 2 of the USFWS concurrence <br />letter, dated Sept 22, 2009, are to be used to control erosion and runoff on drill pads <br />and new access roads. <br />• The use of constructed stream crossings across East Terror Creek will be <br />implemented to reduce the amount of sediment entering the creek. <br />• Streams crossings will not impede the movement of fish up or down stream. <br />Mitigating Measures to be Applied to Public Lands: <br />1. Migratory birds: Seasonal restrictions, from May 15-Aug 1, apply to all vegetation <br />disturbing activities unless the area has a current year clearance survey (see below). <br />a.
