Environmental Consequences/Mitigation: Proposed Action - The impact analysis contained in the 2005 Spruce Stomp EA, the 2005 BA (Gault Group 2005) for the Spruce Stomp EA, the 2009 BA and Evaluation (Monarch and Associates 2009), and the 2010 BA (BLM 2010c) for the BLM portion of the CEL area adequately describe the potential impacts of CEL activities on Endangered, Threatened, Candidate Species, and Critical Habitat within the CEL area. There is no designated critical habitat for listed species in the project area. No direct physical impacts to endangered Colorado River fish are anticipated as a result of the proposed project. However, the endangered fish and their Critical Habitat on the lower Gunnison River and Colorado River (USFWS 1994) could be adversely impacted by the 1.5 acre feet of water depletion that would result from the proposed action. In a Biological Opinion rendered for BLM on February 5, 2009, by the USFWS (#ES/GJ-6-CO-08-F-0010), it was determined that such depletions are likely to adversely affect the Endangered Colorado River fish and their designated Critical Habitat. A 2007 Biological Opinion rendered by the USFWS (ES/GJ-6-CO-99-F-033-CP062) for USFS lands arrived at the same finding. DOI-BLM-CO-S050-2010- 0017 EA Page 25 of 43 May 2010
