<br />I, Randal Sunderland, do solemnly swear that I am managing
<br />editor of the Delta County Independent; that the same is a weekly
<br />newspaper printed, in whole or in part, and published in the County
<br />of Delta, State of Colorado, continuously and uninterruptedly in
<br />said County of Delta for a period of more than fifty-two consecu-
<br />tive weeks prior to the first publication of the annexed legal notice
<br />or advertisement; that said newspaper has been admitted to the
<br />United States mails as second-class matter under the provisions
<br />of the Act of March 3, 1879, and all amendments thereof, and that

<br />I The Color ado Division of Reclamation,
<br />Mining and Safety proposes td
<br />Approve Technical Revision
<br />Application No. 68 (TR-68) for the
<br />Bowie No. 2 Mine (Permit NO, C-1996-
<br />083), submitted by Bowie Resources,
<br />LLC. In Technical Revision No. 68
<br />(TR-68), - Bowie Resources, LLC
<br />(BRL) is proposing to add 80: acres
<br />(I to the west side of the Bowie No. 2,
<br />i, permit area through an incidental
<br />boundary change. BRL is also
<br />:..proposing a mine- plan modification
<br />in this area, which lies to'the. west
<br />of Terror Creek. Only. development
<br />mining will be conducted under TR-
<br />68, with no projected subsidence.
<br />The additional permit, area. and the
<br />mine, plan modification. are needed
<br />to continue mining until the western.
<br />!expansion area is approved in Permit
<br />I. Revision No. 12, which is currently
<br />under review. BRL-has the right to access the coal
<br />through federal -coallease C-37210,
<br />originally assigned to the Bowie. No.
<br />1 Mine but a portion of which will be
<br />accessed from the Bowie.Ne. 2 Mine.
<br />for TR-68. The coal is managed by
<br />the Bureau of Land Management and
<br />the affected surface land is owned
<br />by BBL. No surface disturbance and
<br />no increase in the coal production or
<br />water usage are. proposed in TR-68.
<br />The Bowie NO 2 Mine is an
<br />underground coal mine located in
<br />Delta County, approximately .5 miles
<br />northeast of.Paonia, Colorado. Coal.
<br />interest is Federal and private, and the
<br />surface affected is Federal and private
<br />land. The Permit area encompasses.
<br />approximately 5,944.80 acres.
<br />This proposed decision is`based on.
<br />a finding that the proposed operation
<br />will-.comply with all requirements of
<br />the Colorado Surface_ Coal Mining.
<br />Reclamation Act, Section 34-33-101,
<br />e( seq,,. C.R.S., and the. regulations
<br />promulgated thereunder.
<br />Copies of. the proposed decision,.
<br />,including stipulations. are on file for
<br />pubticinspection at the Colorado
<br />Division of -Reclamation,' Mining
<br />and Safety, Room-215, Centennial
<br />Building, 1313. Sherman Street,
