<br />I, Randal Sunderland, do solemnly swear that I am managing
<br />editor of the Delta County Independent; that the same is a weekly
<br />newspaper printed, in whole or in part, and published in the County
<br />of Delta, State of Colorado, continuously and uninterruptedly in
<br />said County of Delta for a period of more than fifty-two consecu-
<br />tive weeks prior to the first publication of the annexed legal notice
<br />or advertisement; that said newspaper has been admitted to the
<br />United States mails as second-class matter under the provisions
<br />of the Act of March 3, 1879, and all amendments thereof, and that

<br />DECISION '
<br />The Colorado Division of Reclamation,
<br />Mining and Safety proposes to
<br />Approve Technical Revision
<br />Application No. 67 (TR-67)' for the.
<br />Bowie No.2 Mine (Permit No. C- 1996-
<br />063), submitted by Bowie Resources,`
<br />LLC. in•TechnicalRevision No. 67„
<br />BowieResources LLC is proposing;
<br />i toconstruct a ventilation shaft for
<br />the Bowie No. 2 Mine. Thessite lies
<br />in the northeast quadrant of Section
<br />18 of Township 13 South and Range.,
<br />t 91 West. The proposed site is located
<br />( approximately 500 feet east of Terror
<br />Creek on a previously approved and
<br />disturbed drill pad No new surface
<br />disturbance is planned. The surface-
<br />-of this proposed site is managed by
<br />- the, Bureau of Land 'Management
<br />'
<br />I and leased to Bowie Resources LLC'
<br />through -Federal -Coal Lease -COC
<br />t 61209
<br />The ventilation shaft will be bored
<br />l from the bottom `up ?to the top with
<br />the cuttings placed at thecoal waste
<br />stockpile. The shaft will be about 556
<br />feet deep and have arough diameter
<br />of 20 feet The entire shaft will be
<br />lined with concrete to minimize water
<br />infiltration, resulting in a finished
<br />?.? diam`eter of about' 18.5 feet. Once
<br />fhe shah- is constructed, an escape
<br />i.. hoist and nitrogen generator will be
<br />installed on the shaft site pad. Power
<br />for the facilities will be from within tho
<br />mine. No ventilation fan is anticipated
<br />at this time. The shaft and'associated'
<br />surface disturbances :will be bonded
<br />` for reclamation. Access to the site.
<br />will be fromthe Bowie'No. 2 Mine,
<br />UP Steven's Draw and, then, down
<br />the newly approved end constructed
<br />Terror Creek access road.
<br />The Bowie- No ` 2 Mine is an
<br />underground coal mine located in
<br />Delta County, approximately 5 miles
<br />northeast of Paonia, Colorado. Coal
<br />interest is Federal and private, and the
<br />surface affected is Federal and private
<br />land' The permit area encompasses
<br />approximately 5,944.80 acres. This proposed decision is.based on
<br />a finding that the.'all proposed. operation.
<br />will comply with requirements of
<br />the Colorado Surface Coal. Mining'
<br />Reclamation Act Section 34-33-101,
<br />of seg. C.R S and the regulations
<br />promulgated thereunder.
<br />Copies of the proposed decision,.

<br />public inspection at the Colorado -
<br />Division of Reclamation, Mining
<br />and Safety, Room 215; '.Centennial
<br />'.Building, 1313 ''Sherman Street,
<br />Deriver, Colorado 80203. Persons
<br />with an interest that may be adversely
<br />affected by the proposed decision
<br />may request a formal hearing before'
<br />the Mined Land Reclaration_ Board
<br />on the proposed decision. Such
<br />request must be. made within ten
<br />(10) days of the initial publication of
<br />this notice, must be in writing, and
<br />must siate with reasonable specificity-
<br />the reasons for the request and the
<br />objections to the proposed decision.
