PERMIT #: M-1987-026 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: September 2, 2010 <br />CORRECTIVE ACTIONS: Implement the approved weed control plan and provide proof to the Division that <br />this has been done. If a weed control plan is not already in place, the Operator shall develop a weed control and <br />management plan in accordance with Section 3.1.10 (6) of the Rule. This plan should be developed in <br />consultation with the county extension agency, or weed control district office and should include specific control <br />measures to be applied, a schedule for when control measures will be applied and a post-treatment monitoring <br />plan. This weed control plan shall be submitted to the Division as a Technical Revision to the approved permit <br />with the appropriate fee of $216.00 by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 11/01/10 <br />INSPECTION TOPIC #3: Signs & Markers <br />PROBLEM/POSSIBLE VIOLATION: Problem: The affected area boundary markers do not correspond to the <br />approved permit boundary configuration. This is a problem for failure to maintain boundary markers around the <br />affected area as required by Section 3.1.12(2) of the Rule. <br />CORRECTIVE ACTIONS: The Operator shall conduct a survey and replace the boundary markers in the <br />correct location(s). The Operator shall provide proof to the Division that this has been done by the corrective <br />action date. <br />CORRECTIVE ACTION DUE DATE: 11/01/10 <br />INSPECTION TOPIC 44: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem: The current mine plan needs to be updated and clarified <br />pursuant to C.R.S. 34-32.5-112 (1)(c)(vi). The Operator must provide sufficient information to describe or <br />identify how the Operator intends to conduct the operation. <br />CORRECTIVE ACTIONS: The Operator shall submit a Technical Revision, with the required $216 revision <br />fee, to update and clarify the current approved mine plan to reflect existing and proposed activities by the <br />corrective action date. <br />CORRECTIVE ACTION DUE DATE: 11/01/10 <br />OBSERVATIONS <br />This inspection was performed as part of the Division's monitoring inspection program. The representative <br />named on page one was present during the inspection. <br />The following are general and itemized observations from the Division's inspection. <br />The Black Obsidian site is located approximately 1 mile north of Silvercliffe, CO in Custer County. The site <br />was previously inspected by the. Division on August 24, 2005. <br />(FN) Financial Warranty: <br />The Division currently holds a financial warranty of $66,400, which is adequate to complete the reclamation of <br />the site based on the observations from this inspection. <br />Page 2 of 5
