tequested By: sib 03/2812008 <br />instrument Book Page <br />200800696948 OR 1475 1955 <br />Administration (the " Approving A enc "), Lessee shall provide a copy of such proposed <br />plan to Lessor at least 72 hours in advance of Lessee's submission of such proposed plan <br />to th Approving Agency, in order that Lessor can review such proposed plan for surface <br />impacts and comment on such impacts. <br />16. RECLAMATION. All plans for restoration and Teclamation of the Leased Premises are <br />subject to review and approval by Lessor to determine compliance with applicable State <br />laws. In addition to being subject to Lessor's review, restoration and reclamation must <br />meet all requirements of the Colorado Surface Coal Mining Reclamation Act. Variations <br />from those requirements or from any approved plan, and any amendment to plans, are <br />subject to Lessor's approval. In the event Lessor fails to respond within sixty (60) days <br />following its receipt from Lessee of a plan for restoration and reclamation of the Leased <br />Premises or of an amendment to an approved plan, Lessor shall be deemed to have <br />approved such plan or amendment, as applicable. This Section 16 shall have application <br />only when Lessor owns or controls the surface above the Leased Premises. <br />17. OTHER STATE AGENCIES. Instruments and documents required by other State <br />agencies may satisfy certain requirements of this Lease. In the event that Lessee is <br />required to file instruments and documents with other State agencies, such as DRMS, <br />etc., Lessee shall notify Lessor of said filing and Lessor reserves the right to request and <br />obtain copies of such instruments and documents from Lessee. <br />I& INSPECTION. It is agreed that during Lessee's normal business hours and at all times <br />during the continuance of this Lease, Lessor or its duly authorized agent, is hereby <br />authorized to check scales as to their accuracy, to go on any part of the Leased Premises <br />to examine, inspect, survey and take measurements of the same and to examine and make <br />extracts from or copies of all books a�e� �a any <br />way the coal output, coal values, pay royalties from and of the Leased serve or examination <br />Premises, and that all conveniences necessary for said inspection, y� <br />shall be furnished to Lessor. Lessor may require Lessee to provide all instruments and <br />documents of any kind and nature whatever which affect Lessor's interests. <br />19. MINING METHODS Only underground mining methods that are consistent with <br />prevailing good mining practice shall be used by Lessee. Lessee may not mine by any <br />strip or surface mining method. Further, this Lease does not give Lessee the right to <br />construct a portal on the surface overlying the Leased Premise rea that i o wned rotect the coal <br />for access to the coal leased hereunder. Lessee also agrees o ound mining <br />beds above and below the coal bed being mined through the <br />operation. <br />20. NOTICES. Any notice required to be given to Lessee under the provisions of this Lease <br />shall be sent by certified mail to the address set forth at the beginning of this Lease or to <br />such other address as Lessee may indicate in writing to Lessor, and such service by mail <br />shall be deemed sufficient and in full compliance with the terms of this Lease as of the <br />date it is postmarked. Notice to Lessor shall be given in like manner and addressed to the <br />Colorado Division of Wildlife's headquarters postal address. <br />Page 11 of 17. <br />
