Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety (the Division) has issued a proposed decision <br />to Approve Bond Release Application No. 1 (SL-1) and terminate the Division's regulatory jurisdiction <br />for the Arness McGriffin Mine, Permit Application No. C-1981-042. The affected area is located in La <br />Plata County, approximately 4 miles West of Durango on the north side of U.S. Highway 160. The <br />operator, Sam Arness, applied for a coal mining and reclamation permit for the site (Application No. <br />C-81-042), but did not complete the application process. The operator had disturbed 5 acres on the site <br />in preparation for underground coal mining, but ceased operations prior to excavating a portal and <br />underground entries. The Mined Land Reclamation Board issued a Cessation Order in 1984, and <br />ordered forfeiture of $13,750 of reclamation bond that had been associated with permit 77-3 ug/c, a <br />Minerals Program permit 77-3 ug/c that had been applicable to the site. <br />The Division reclaimed the disturbed area on the Arness-McGriffin site in 1989 and 1990, using all of <br />the funds from the forfeiture of bond associated with permit 77-3 ug/c. The Division prepared a bond <br />release/termination of jurisdiction findings document in 2010. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the La <br />Plata County Clerk & Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
