Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety (the Division) has issued a proposed decision <br />to Approve Bond Release Application No. 1 (SL-1) and terminate the Division's regulatory jurisdiction <br />for the Coal Gulch Mine, Permit No. C-1984-067. The mine was operated by Peerless Resources, Inc. <br />under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The affected area is <br />located in La Plata County, approximately 4 miles west of Durango on the north side of U.S. Highway <br />160. The permittee disturbed 16.5 acres on the site in preparation for underground mining, but ceased <br />operations prior to excavating a portal and underground entries. The permit area encompassed 725 <br />acres. The Mined Land Reclamation Board revoked permit C-1984-067 in January 1988, and the <br />Division reclaimed the disturbed area on the site in September 1994 using all of the $140,000 of <br />forfeited reclamation bond. A bond release/termination of findings document was prepared by the <br />Division in 2010. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the La <br />Plata County Clerk & Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
