Dear Mr., Berry <br />This is the 22" a day of September 2010 and Mr. And Mrs, Morgan and Michael Morgan spoke <br />with Western Fuels Attorneys today, Chris Damper, and was told by him that Western Fuels is <br />not paying the royalty payment unless the Morgans agree to drop all of their objections to PR-06. <br />This sounds like black mail to me. Also they acre now in default of their lease agreement. <br />We all have the right as citizens and landowners to file an. objection to PR-06 and withholding <br />their royalty monies for the coal that they are mining should also be something that the State and <br />the Federal. Government could get involved in. If they do not have a valid lease, that seems to <br />irnply numerous violations. We have still. many objections to the way PR-06 is written. The <br />present day mining that they had been doing was being well-watched and being done properly for <br />the most part and we were not objecting to this particular phase of the mining. The soil re- <br />distribution and the reclamation we stall have warty concerns and objections to. We will. continue <br />to work through some of those objections by submitting documentation to their attorneys, <br />however, if the royalty payments are not made, then. they have no rights on this property and the <br />lease has been defaulted many time now, and without a valid lease, they do not have a permit, <br />and defaulting in a mining permit is very serious. <br />Thank you for you time <br />I Jo en Turner
