WESTERN FUELS COLORADO <br />A Limited Liability Company <br />New Horizon 1 Permit Boundary <br />(Garvey /Rice Tract) <br />The following provides a description of the permit boundary of the New Horizon 1 Mine. This <br />boundary is what remains after the successful Phase III bond release in 2001/2002. This tract <br />is also know as the Rice Tract or the Garvey Tract. <br />The New Horizon 1 Permit Area lays within Section 25 Township 47N, Range 16W of the New <br />Mexico Principal Meridian, Montrose County, Colorado, or described specifically as follows: <br />Commencing at the southeast corner of said Section 36, Township 47N, Range 16W, <br />thence N 240019" W, 5925.11' to a point of beginning ; <br />thence N 87d20'48" W a distance of 2653.91'; <br />thence N 01d33'47" E a distance of 1574.33'; <br />thence S 89d02'59" E a distance of 2670.39'; <br />thence S 02d08'43" W a distance of 1653.48'; <br />which is the point of beginning, <br />having an area of <br />4,295,900 square feet, <br />98.621 acres <br />Attachment 2.03.8 -1 -4 <br />
