Inadequate Submittal
Dear Ms. Sprague,
On August 10, 2010 the Division of Reclamation, Mining and Safety (Division) received an
updated Wells Fargo Bank, N.A. Irrevocable Letter of Credit the amount of
$137,100.00 for the above referenced site. The Division reviewed the submittal and found the
Letter of Credit was inadequate and could not be accepted. On August 11, 2010 a letter (copy
enclosed) was sent to the Operator outlining the deficiencies which must be corrected prior to the
Division's acceptance of the Letter of Credit.
The Division has not received the updated bond forms or the completed Financial Warranty
Letter of Credit form. According to the Division's records, the increased financial warranty was
to be accepted prior to July 30, 2010. Per the requirements of Construction Materials Rule
4.2.1(2), the Permittee shall have up to 60 days to post the additional Financial Warranty from
the date of written notice from the Division of such insufficiency. The Permittee must submit
the additional Financial Warranty in an approvable form by October 4, 2010.
Please note that if the Permittee does not submit the additional Financial Warranty in an
approvable form by the date provided above, then the Permittee will be scheduled for a Formal
Board Hearing for possible revocation of the permit.
