09-20-10;03:05PM; ;970-498-5678 <br />The Box Elder Ditch has historically diverted water under <br />its water rights from April through October. During these months <br />replacement water will be provided from this source. <br />From September through the consecutive April there was <br />either no diversion by the ditch or the diversion was <br />insufficient to fully cover the replacement requirement in a <br />given month. For these months the replacement requirement is <br />provided from the Windy Gap water earlier identified in numbered <br />paragraphs 3.b., 6. and 8.b. <br />13. Augmentation procedure. The method of augmentation has <br />been defined for two distinct phases of the operation. In the <br />mining phase only a portion of the proposed free water surface <br />has been created, requiring only a portion of the replacement <br />water to be provided. In determining the injury to senior water <br />rights during the mining phase, water losses attributable to dust <br />control,, and the water removed from the site in the gravel <br />product, must be also considered and replaced- The Hoxelder <br />water will be used only for dust suppression during the mining <br />phase, gravel washing, augmentation purposes as provided in this <br />decree, and for irrigation of any remaining irrigable acreage•on <br />the Applicant's 139 acre tract. <br />Also, during the mining phase the mining is done with <br />dewatering the pit being mined at the given time, returning this <br />water to the river through the tail end of the Sox Elder Ditch. <br />This process will not only reduce evaporation from the mined pit, <br />but also will deliver water to the river. <br />Any shortfalls during the mining phase will be covered from <br />the above described Windy Gap source according to the request of <br />the Water commissioner. <br />After mining has been completed site rehabilitation will <br />follow. In this process shore shaping, landscaping and overflow <br />facilities between neighboring ponds will be completed. The pond <br />high-water elevations will be highest in the Northwest end of <br />the property i.e• in Ponds G and H, and they will be the lowest <br />in Ponds A and 1. <br />During the ditch diversion season Ponds G and H will receive <br />ditch-water, which then will proceed from Pond H to Y and back to <br />the ditch on the north side of Box Elder Ditch, and, on the south <br />side, from Pond G to F, F to G and E, from E to D, and from C to <br />B, and D to B, then from B to A and finally from A back to the <br />Box Elder Ditch. Throughout this season the ponds will be kept <br />full denying ground water entry into the ponds, evaporating only <br />ditch water. <br /># 7/ 32 <br />6
