09-20-10;03:05PM; <br /> <br />;970-498-5678 # 5/ 32 <br />Plant No. 2 and Platte River has agreed to deliver, convey and <br />release perpetually for use by the Applicant up to 100 acre feet <br />of the waters annually discharged by A-B at the time and in the <br />amount requested by the Applicant. <br />Said right to receive water by the Applicant commences <br />October 1, 1993 and is perpetual so long as Platte River's <br />Rawhide Energy Station and the Anheuser Busch Fort Collins <br />Brewery are operative. <br />C. Uses; In addition to irrigation use, Applicant's <br />shares of Boxelder Irrigation Company may be used for <br />augmentation, gravel washing, and dust suppression. Applicant's <br />shares of Windy Gap water may be used for augmentation, fire <br />replacement, piscatorial, recreation, storage, Industrial, protection, and supply. <br />g. Water demands. The average water demand to cover <br />winter deficits with 60% irrigation efficiency in acre feet are <br />as follows: September, 4.0; October, 14.5; Novembex, 11.4; <br />December 10.2, January, 0; February, 0; March, 14.5; April 23.0. <br />The subject property and gravel pit operation have excess water <br />from May through September, in terms of historic headgate <br />diversions as follows: May, 37.7; June, 40.5; 7rly 78.G; August, <br />40.0. These numbers are average figures, <br />months of certain years it is passible that the yield of <br />Applicant's Boxelder water will be insufficient to replace the <br />evaporative loss that is then occurring from the ponds' surfaces. <br />Should that occur, and upon the direction of the Division be <br />Engineer, or his representative, Applicant shall cause to released to the Cache La Poudre River a sufficient amount of its <br />Windy Gap Water to replace such injury. <br />The Strang Gravel Pit presently has a combined open water <br />surface area of approximately 24 acres. Out of this, 3.2 acres <br />were existing on December 31, 1980. <br />Boxelder Ditch diverts water from the Cache La Poudre River <br />two miles north and one mile west of the subject property. <br />Approximately 2,200 acres are irrigated under this ditch. With a <br />total of 64 shares outstanding, this indicates that each share <br />irrigates about 34.4 acres, which is practically identical to the <br />subject property's historic farm irrigation, where the unit <br />irrigation is 34.7 acres per share. <br />Upon completion of the gravel mining and after reclamation, <br />the combined pond areas are projected to amount to 98.7 acres. <br />Consequently, there will be a potential 95.5 acres of exposed <br />water surface which must be considered in this augmentation plan. <br />4
