09-20-10;03:05PM; ;970-498-5678 # 22/ 32 <br />(a) A payment of $750 for each acre-foot of water, up to 10 acre-feet, first. <br />delivered in 1994; such payment to be due and payable on or before March 31,199 <br />(the following year); <br />(b) Additional payments of $750 for each additional acre-foot of water (up <br />to both the ultimate total quantity of 100 acre-feet and full payment of $75,000) first <br />delivered in any subsequent years to the County at the County's request; such <br />payments to be due and payable on or before March 31st of the year following the <br />year the water is first delivered; <br />(c) Provided however, that, regardless of the actual quantity of waters <br />delivered and-conveyed on or before December 31, 2003, any remaining balance of <br />the $7'5,000' total compensation to be paid by the County to Platte River under this <br />Agreement, shall be deemed due and payable by the County on or before March 31, <br />2004. Notwithstanding the foregoing, the County may at its option based on its <br />augmentation needs, elect to purchase a lesser amount than 100 acre-feet of said <br />waters, In which case. the County shall so notify Platte River and .the final amount <br />due Platte River shall be adjusted accordingly on the basis of $750/acre-foot for this <br />annual delivery; provided that such written notice shall be given by December 31, <br />1998, or later by mutual agreement. <br />(3) The water conveyances, releases, and deliveries of water rights as <br />outlined in this AGREEMENT will commence ?a ?? an a er etual s - 5 ? <br />long'as Platte River's Rawhide Energy Station ande-?#regit are operative. <br />Upon the termination of operations of Platte River's Rawhide Energy Station or th by <br />termination of Larimer County's ownership of the Strang Pit or the dissolution of <br />either signatory entity, the parties agree to mutually undertake to pass the ability to <br />maintain the rights herein described to the successor entities and/or owners. <br />Dated: THE.
