PERMIT #: M-1995-026 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: September 2, 2010 <br />OBSERVATIONS <br />This inspection was performed as part of the Division's monitoring inspection program. The representative <br />named on page one was present during the inspection. The site was previously inspected by the Division on <br />August 24, 2005. <br />The following are general and itemized observations from the Division's inspection. <br />The site is located approximately 6 miles south of Westcliffe, CO in Custer County. <br />(MP) Gen. Compliance With Mine Plan: <br />The site is actively mined by Custer County Road and Bridge. The site is permitted for 40.30 acres of <br />disturbance divided into four 10 acres phases. The current mining disturbance is contained within phase one <br />located in the southwest corner of the site. Mr. Trujillo estimates one more year of mining resource remains in <br />the northwest corner of the phase. A processing plant and mining equipment (dozers and loaders) were <br />observed during the inspection. The pit floor was dry and stockpiles of oversized material were located at the <br />south end of the pit. The oversized stockpiles will be processed by a contract mining company in the future. <br />Custer County Road and Bridge plans to continue mining to the north into Phase 4 instead of moving east into <br />Phase 2. <br />The northeast corner of Phase 3 near the entrance gate is currently used as a stockpile area by the County. A <br />stockpile of imported material from the County Landfill was observed during the inspection. The imported <br />material is being trucked back to the landfill as needed and will not be placed in the pit. <br />The east and north slopes in Phase 1 have been mined to a temporary 3H:1 V slope as required in the approved <br />mine plan. Overall, the site appeared stable and well organized. <br />The Operator mentioned the possibilities of mining Phase 1 deeper in the future and incorporating the mine site <br />into the landfill following completion of mining at the site. The site is currently approved for a total mining <br />depth of 40 feet deep, based on the cross-sections profiles submitted with the original permit application. A <br />technical revision, per Rule 1.9, would be required to revise the Mining Plan if the Operator decides to mine the <br />site greater than 40 feet deep. The Operator would be required to submit and get approval for a permit <br />amendment, per Rule 1. 10, to incorporate the site into the landfill. The Division encourages the Operator to <br />contact and discuss any changes to the site prior to deviating from the approved mine and reclamation plans. <br />(RS) Reclamation Success: <br />The approved post mine land use for the site is rangeland. Reclamation activities have begun at the site. The <br />west slope of Phase 1 has been re-topsoiled and seeded with the approved reclamation seed mix. The slope <br />appeared stable and the vegetation was establishing well. Two large topsoil stockpiles are located along the east <br />side of Phase 2. Mr. Trujillo stated the existing stockpiles will not be used to reclaim Phase 1 as originally <br />planned. The topsoil and overburden from Phase 4 will be stripped and used to reclaim Phase 1 progressing <br />from the south to north. <br />(SC) Sediment Control: <br />The stormwater control berm located at the south end of Phase 1 and the stormwater structures for the access <br />road and the temporary north slope were observed during the inspection. All sediment appeared to be well <br />controlled and contained within the permit boundaries. <br />Page 2 of 5
