The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the
Colorado Revised Statutes, hereby issues notice that on August 13, 2010, a minor revision application
(MR-368) to the West Elk Mine, Permit No. C-1980-007, operated by Mountain Coal Company,
LLC, P.O. Box 591, Somerset, CO 81434 was considered complete for the purposes of filing. The
operator has submitted a drawing that shows the phases of construction planned for the buttress of the
Refuse Pile Expansion East. All reviews and comment periods as provided in the Act and Regulations
promulgated thereunder initiate from this date of filing.
