In addition to providing the requested information, please be advised that any actions taken to <br />permanently seal, plug or abandon the pipe may require additional permitting review and <br />approval before proceeding regardless of its location within the permit area. Also discussed <br />was Cotter's plan to utilize a borehole camera to try and determine the originating end of the <br />pipe. The Division requests that the results from this procedure be provided to our office as <br />soon as they are available. A final point is that a future event of this sort could trigger reporting <br />under the emergency provisions of Rule 8.1 of the MINERAL RULES AND REGULATIONS OF THE <br />COLORADO MINED LAND RECLAMATION BOARD FOR HARD ROCK, METAL AND DESIGNATED MINING <br />OPERATIONS. Please review this rule and be aware of the provisions that may trigger a future <br />notification under that rule. <br />Another area where we would like some clarification is on information that was included in <br />Cotter's Petition for Reconsideration filed August 31, 2010. Information included in the filing <br />states that Cotter has, in addition to re-starting Sump # 1, re-started Sump # 4 and also initiated <br />pumping out of monitoring well # 9. To the Division's knowledge, these last two items were not <br />included in the approval of TR-12 and may require review and approval to continue these <br />additional activities. Please explain all facets of the on-the-ground activities associated with <br />implementation of TR's 12 & 13 including source water being transmitted to the plant and all <br />pipe and power line locations. <br />Please respond to these questions at your earliest opportunity but by no later than September <br />24th, 2010.
