because uranium concentrations in the pipe flow are 78 percent of concentration in the mine <br />pool. Id. After receipt of this inconclusive information, Cotter conducted another evaluation by <br />entering the major ions into an AgQA computer program, which suggested that the mine pool <br />water is consistent with the pipe water. Cotter also retained COLOG, a borehole geophysics <br />company, to generate a three-dimensional image of the underground path of the pipe and a video <br />record of what is encountered inside the pipe through a video camera/accelerometer. COLOG <br />came to the Schwartzwalder Mine on September 13, 2010 and was able to advance the <br />equipment 40 to 50 feet, but could not advance the equipment further because of a bend in the <br />pipe. Cotter is continuing to work with COLOG in planning additional investigations. <br />Therefore, Cotter still does not have confirmation of a connection between the pipe and the mine <br />.Pool. <br />While the Division Response states at page 2 that "Cotter believes the pipe is conveying <br />water from the mine pool" and states at page 6 that "Cotter now states that a pipe has discharged <br />water from the mine pool," Cotter actually stated that water may be coming from the mine pool, <br />but some information is inconsistent with that theory, and it is conducting further investigation <br />by retaining a borehole company. In addition, the Division Response states at page 3 that <br />"[a]ccording to Mr. Hamrick, the level of the mine pool water rapidly [sic] and recently <br />decreased by 6 inches, which he stated coincided with the discovery of the pipe." Mr. Hamrick <br />does not recall stating that the decrease coincided with the discovery of the pipe. The 6-inch <br />decrease occurred on July 1, 2010, and he recalls this fact being conveyed to Mr. Waldron and <br />Mr. Bird on September 9, 2010. <br />Whetstone has concluded that water which discharged from the pipe is expected to report <br />to MW 9 and Sump No. 1, based on groundwater flow directions in the alluvium and fill.
