1124137-2 <br />Notice of Proposed Decision <br />The Colorado Division of Reclamation, <br />Mining and Safety has issued a pro- <br />posed decision to Withdraw Bond Re- <br />lease Application No. 2 (SL-2) for the <br />Williams Fork Mines, Permit No. <br />0-1981-044. The mine is operated by <br />BTU Empire Company, LLC under the <br />provisions of the Colorado Surface <br />Coal Mining Reclamation Act of 1979. <br />The bond release application was sub- <br />mitted by BTU Empire Company, LLC <br />on September 17, 2004. BTU Empire <br />Corporation (formerly Known as <br />RAG-EC) had requested release of lia- <br />bility subsidence impacts for lands <br />overlying underground workings. The <br />areas requested for release lay west of <br />Colorado State Highway 13 and Portal <br />No.5 facilities area The affected area is <br />located in Moffat County, approxi- <br />mately 7 miles Southwest of Craig, <br />Colorado. On August 4, 2010, BTU-EC <br />requested this bond release application <br />be withdrawn. <br />Copies of the proposed decision are <br />available for review at the Colorado Di- <br />vision of Reclamation, Mining and <br />Safety office, 1313 Sherman Street, <br />Room 215, Denver, Colorado 80203, <br />and at the office of the Moffat County <br />Clerk and Recorder. <br />Any person who has an interest which <br />is or may be adversely affected may re- <br />quest an adjudicatory hearing regard- <br />ing this proposed decision. Requests <br />for a hearing must be made in writing <br />within thirty (30) days of the first publi- <br />cation of this notice, and shall state <br />with reasonable specificity the reasons <br />for the request and objections to the <br />proposed decision. <br />Published in The Craig Daily Press <br />Publication Date: August 9, 2010 <br />10233829
