August 24, 2010 C-1981-019/Colowyo Coal Mine JR <br />- The portion of the Section 16 Pit that is included in the Phase I, II and III Bond Release is generally the upper <br />(western) portion of the pit just east of the final cut area. Runoff from this area is conveyed in either the Section <br />16 Pond Ditch or the Section 16 Fill Ditch to the Section 16 Pond or the South Collection Ditch to the Prospect <br />Pond. None of these ditches are within the Phase I, II or III Bond Release areas and all of these ditches convey <br />water from disturbed or reclaimed areas that have not been released and are not included in the SL-04 and SL-05 <br />applications. <br />ROADS - Rule 4.03 Construction 4.03.1(3)/4.03.2(3); Drainage 4.03.1(4)/4.03.2(4); Surfacing and Maintenance <br />4.03.1(5) and (6)/4.03.2(5) and (6); Reclamation 4.03.1(7)/4.03.2(7): <br />- There are several two-track roads within the Phase I,11 and III Bond Release areas at the Colowyo Mine (running <br />basically north-south). The main road is an access road along the power line corridor. The power line is owned <br />by Tri-State and there is a question whether Tri-State has a right-of way for this corridor. One of the issues that <br />will need to be resolved prior to any possible Phase III release of this area is the status of the power line. Colowyo <br />will need to provide the Division with documentation regarding the power line and corridor regarding its status <br />(whether it is permanent, who owns the line, etc.) and will need to submit a minor revision to the permit to include <br />this information. <br />- There was a small network of two-track roads in the Phase III Bond Release that were used by Colowyo to <br />remove power poles that remained from an old power line. These poles were permitted to be removed and <br />Colowyo has removed them, as required. These two track roads basically knocked down the vegetation and did <br />not cause any further disturbance to the reclaimed areas. The Division does not have any concerns with these <br />roads; as they should be heal themselves by the next growing season. <br />- There is an access road in the Section 16 Pit (crossing some of the Phase I and II areas) that leads to the Section <br />16 Pond. This road has become somewhat filled in with vegetation and is now basically a two-track road. The <br />sides of the tracks, however, have some erosional problems (gullying) that will need to be fixed. This gullying is <br />seen in several places along the road that are not included in this bond release as well. The portion of the road that <br />crosses the Phase I and II areas will be excluded from the SL-04 application. The exclusion area is approximately <br />0.2 acres. <br />REVEGETATION/RECLAMATION SUCCESS - Rule 4.15; Rule 3; Rule 4.15 Vegetative Cover; Timing: <br />- Colowyo has aplied for 432.70 acres of Phase II Bond Release and 987.32 acres of Phase III Bond Release in <br />the East Pit, West Pit and Section 16 Pit.
