Colowyo has requested the Phase III release of 932.40 acres of reclamation in the East Pit. There is a Tri- <br />State power line and two-track road that runs through the reclamation area. Colowyo has stated that Tri- <br />State owns the power line and that they have a right-of-way corridor along the power line. Since this <br />power line will remain following the Phase III Release of the area, Colowyo will need to provide a letter <br />from Tri-State stating that they own the power line and that they have a right-of-way along the corridor. <br />Colowyo will also need to provide a letter from the landowner stating that Tri-State has a right-of-way for <br />the power lines and a map or plate within the SL-05 application showing this right-of-way. Finally, <br />Colowyo will need to provide a minor revision to the permit describing the Tri-State power line and right- <br />of-way, including its location, ownership and acreage. <br />8. There are several shrub plots in the proposed Phase III Bond Release area that have been fenced. <br />Colowyo will either need to remove the fences or provide a minor revision to the permit discussing the <br />fenced shrub plots and the retention of the fences as a permanent, post-mining feature. If Colowyo <br />decides to retain the fences, they will need to be repaired. <br />9. There are several locations within the Phase III Bond Release area that have snow fence. Many of these <br />snow fences are either knocked down or are in general disrepair. Colowyo will need to either remove the <br />snow fences or provide a minor revision to the permit discussing the snow fences and the retention of the <br />fences as a permanent, post-mining feature. If Colowyo decides to retain the snow fences, they will need <br />to be repaired. <br />10. There were several thistle patches (including Canadian Thistle) noted in the Phase II/III reclamation areas <br />as shown on Inspection Map 13. Prior to proposing a decision on bond release applications SL-04 and <br />SL-05, Colowyo will need to spray these thistle areas. Colowyo will need to provide written and <br />photographic documentation that these areas have been sprayed. <br />11. Within the Phase III Bond Release area, Colowyo is requesting the release of eight stock tanks (A-F and <br />L and M). Prior to the release of these stock tanks, Colowyo must provide written documentation that the <br />criteria for permanent impoundments have been met pursuant to Rule 4.05.9(13). Additionally, Colowyo <br />must provide documentation that these stock tanks have been permitted with the State Engineer's Office. <br />Finally, Colowyo must provide a letter from the landowner requesting the stock tanks remain as <br />permanent structures and submit a technical revision to the permit to include the stock tanks as permanent <br />structures. <br />12. There was a small, approximately 0.20 acre, slump on the edge of the undisturbed area in reclamation <br />block EP024. This slump was approximately 160' long x 60 feet wide x five feet deep. There was <br />vegetation growing on/around the slump but it was difficult to tell whether the slump was still moving. <br />The Division is not going to exclude this area from the Phase III Bond Release but Colowyo will need to <br />continue monitoring the location. If the slump moves or continues to move it could cause problems for <br />the Gulch A Ditch, the East Side Collector Ditch and/or the Gulch A Pond. <br />13.
