NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 68 (TR-68) for the Bowie No. 2 Mine (Permit No. C-1996-083), submitted by Bowie <br />Resources, LLC. In Technical Revision No. 68 (TR-68), Bowie Resources LLC (BRL) is proposing to <br />add 80 acres to the west side of the Bowie No. 2 permit area through an incidental boundary change. BRL <br />is also proposing a mine plan modification in this area, which lies to the west of Terror Creek. Only <br />development mining will be conducted under TR-68, with no projected subsidence. The additional permit <br />area and the mine plan modification are needed to continue mining until the western expansion area is <br />approved in Permit Revision No. 12, which is currently under review. <br />BRL has the right to access the coal through federal coal lease C-37210, originally assigned to the Bowie <br />No. 1 Mine but a portion of which will be accessed from the Bowie No. 2 Mine for TR-68. The coal is <br />managed by the Bureau of Land Management and the affected surface land is owned by BRL. No surface <br />disturbance and no increase in the coal production or water usage are proposed in TR-68. <br />The Bowie No. 2 Mine is an underground coal mine located in Delta County, approximately 5 miles <br />northeast of Paonia, Colorado. Coal interest is Federal and private, and the surface affected is Federal and <br />private land. The permit area encompasses approximately 5,944.80 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
