NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 67 (TR-67) for the Bowie No. 2 Mine (Permit No. C-1996-083), submitted by Bowie <br />Resources, LLC. In Technical Revision No. 67, Bowie Resources LLC is proposing to construct a <br />ventilation shaft for the Bowie No. 2 Mine. The site lies in the northeast quadrant of Section 8 of <br />Township 13 South and Range 91 West. The proposed site is located approximately 500 feet east of <br />Terror Creek on a previously approved and disturbed drill pad. No new surface disturbance is planned. <br />The surface of this proposed site is managed by the Bureau of Land Management and leased to Bowie <br />Resources LLC through Federal Coal Lease COC-61209. <br />The ventilation shaft will be bored from the bottom up to the top with the cuttings placed at the coal waste <br />stockpile. The shaft will be about 550 feet deep and have a rough diameter of 20 feet. The entire shaft will <br />be lined with concrete to minimize water infiltration, resulting in a finished diameter of about 18.5 feet. <br />Once the shaft is constructed, an escape hoist and nitrogen generator will be installed on the shaft site pad. <br />Power for the facilities will be from within the mine. No ventilation fan is anticipated at this time. The <br />shaft and associated surface disturbances will be bonded for reclamation. Access to the site will be from <br />the Bowie No. 2 Mine, up Steven's Draw and, then, down the newly approved and constructed Terror <br />Creek access road. <br />The Bowie No. 2 Mine is an underground coal mine located in Delta County, approximately 5 miles <br />northeast of Paonia, Colorado. Coal interest is Federal and private, and the surface affected is Federal and <br />private land. The permit area encompasses approximately 5,944.80 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
