As OSMRE has oversight authority over CDRMS, and receives copies of the coal <br />mine inspections by CDRMS, we would appreciate your staff reviewing and incorporating <br />this rebuttal into the file, so that the assertions and conclusions made by the CDRMS do not <br />become accepted as fact. <br />Please also be aware that the landowner and permittee has issues with this specific <br />inspector conducting inspections on the landowners property as the inspector was <br />employed by a third party with a former mining interest on the landowners property, and <br />there was and continues to be an adversarial relationship between the parties. This former <br />relationship has the appearance of a conflict of interest, which should be avoided by the <br />State of Colorado program.
