S ° <br />PERMIT #: M-1994-096 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: September 9, 2010 <br />OBSERVATIONS <br />This was a follow-up inspection conducted for a 112c sand and gravel operation conducted by Eric Scott of DRMS for the <br />Russel Pit site operated by High Plains Sand and Gravel. DRMS met with permittee representative Robert Pittington Jr. at <br />the site at approximately 10:00 and observed the current condition of the site with him. This inspection was conducted to <br />evaluate the current conditions at the site prior to the MLRB hearing to take place on Sept 15, 2010. On July 16, 2010 an <br />RTB letter was sent to the operator for failure to maintain a financial warranty in good standing for the life of the permit, <br />and failure to comply with the required performance warranty as required by the Act. A previous site inspection was <br />conducted on August 16, 2010 by DRMS, however, at that time much recalmation work remained to be done, so the <br />follow up inspection was conducted. <br />Although the possible violation for failure to maintian adequate bond is still present, DRMS was very pleased to note that <br />reclamation work has been proceeding well since the last inspection. Approximately 80%, and possibly more, of the <br />earthwork has been completed at this time. Earthwork was on-going at the time of the inspection, and if continued, could <br />be completed by the MLRB hearing date. The completed sloping appears to be well done, with only a small area near the <br />pit access road remaining to be resloped. Topsoil has also been replaced over the majority of the disturbed area, and was <br />being prepared for seeding at the time of the inspection. All equipment and stockpiles have been removed from the <br />former pit area, and the former large overburden and topsoil stockpiles located at the east end of the permitted area are <br />being well-utilized in the reclamation at this time. <br />DRMS would like to propose to MLRB a recalculation of the required reclamation bond, based on the amount of work <br />completed at the time of the MLRB hearing. DRMS believes that if the operator continues with the approved reclamation <br />at this rate, the bonding requirement would be drastically reduced by that time. If the operator was then able to post the <br />reduced bond amount and regain compliance, the permit may not need to be revoked, and the site could then continue <br />with reclaimation and release in a typical fashion. <br />Inspection Contact Address <br />Robert Pittington <br />High Plains Sand and Gravel, LLC <br />P.O.
