The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33,
Section 118, Paragraph 3, of the Colorado Revised Statutes, that on September 15, 2010, an application to renew an
existing permit to conduct coal mining operations at the Marr Mine was considered complete for the purposes of
filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules
initiate from this date of filing.
Kerr Coal Company has applied for renewal of the DRMS permit for the Marr Mine and Loadout. Mining ceased in
1993. The purpose of the renewal is to allow Kerr Coal Company to complete reclamation activities for another 5-
year period or until final bond release is obtained, whichever may occur sooner. No new disturbances are proposed in
this application.
The surface coal mine is on land located approximately 12 miles east of Walden, Colorado. The loadout is located
south of Walden. The permit area is further described as follows:
T8N, R78W, Portions of Section 2
T9N, R78W, Portions of Sections 22, 23, 25, 26, 27, 35
T9N, R79W, Portions of Sections 28, 29 (loadout)
The above-mentioned tracts of land are shown on USGS 7.5 minute quadrangle maps of Johnny Moore Mountain,
Gould NW, Walden and Eagle Hill.
In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your
concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations will
not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by
the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, or
local agency with jurisdiction over the park or place." Therefore, we request that you submit comments regarding
your concurrence with, concerns with, or objections to this proposal. In order that we may comply with regulatory
