PiReda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on September 15, 2010, an application to renew an <br />existing permit to conduct coal mining operations at the Marr Mine was considered complete for the purposes of <br />filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules <br />initiate from this date of filing. <br />Kerr Coal Company has applied for renewal of the DRMS permit for the Marr Mine and Loadout. Mining ceased in <br />1993. The purpose of the renewal is to allow Kerr Coal Company to complete reclamation activities for another 5- <br />year period or until final bond release is obtained, whichever may occur sooner. No new disturbances are proposed in <br />this application. <br />The surface coal mine is on land located approximately 12 miles east of Walden, Colorado. The loadout is located <br />south of Walden. The permit area is further described as follows: <br />T8N, R78W, Portions of Section 2 <br />T9N, R78W, Portions of Sections 22, 23, 25, 26, 27, 35 <br />T9N, R79W, Portions of Sections 28, 29 (loadout) <br />The above-mentioned tracts of land are shown on USGS 7.5 minute quadrangle maps of Johnny Moore Mountain, <br />Gould NW, Walden and Eagle Hill. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your <br />concurrence in order to approve this proposal. We are required to make a finding that "the proposed operations will <br />not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by <br />the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, or <br />local agency with jurisdiction over the park or place." Therefore, we request that you submit comments regarding <br />your concurrence with, concerns with, or objections to this proposal.
