Rule 4.05.4(2) "...the design and construction shall be certified by a qualified registered <br />professional engineer as meeting all applicable performance standards and design criteria <br />... The longitudinal profile of the stream, the channel, and the floodplain shall be <br />designed and constructed to remain stable and to prevent, to the extent possible, using the <br />best technology currently available, additional contributions of suspended solids to <br />streamflow or to runoff outside the permit area." <br />Rule 4.05.4(4) "...When permanent diversions are constructed or stream channels <br />restored after temporary diversions, the drainage design shall emphasize channel and <br />floodplain dimensions that approximate the premining configuration and that will blend <br />with the undisturbed drainage above and below the area to be reclaimed. The average <br />stream gradient shall be maintained with a stable longitudinal profile and the channel and <br />floodplain shall be designed and constructed to the extent possible..." <br />Rule 4.05.6(2) "Sedimentation ponds and other treatment facilities shall be designed, <br />constructed and maintained in compliance with 4.05.6 and 4.05.9." <br />The abatement date for NOV CV-2010-004 is 19 November 2010. Although Colowyo <br />has not yet completed the abatement, they have started to do the work necessary to abate <br />the violation. They have been cooperating with the Division and have been in contact <br />with the Division regarding the abatement of the violation and they have provided <br />information requested by the Division on a timely basis. <br />Please let me know if you have any questions or need any additional information. <br />cc: Sandy Brown w/out Attachments
