Box 533 <br />Pueblo, CO 81002-0533 <br />COLORADO <br />D 1 V 1 S 1 O N O F <br />RECLAMATION <br />MINING <br />SAFETY <br />Re: Fox No. 1 Clay Pit, Technical Revision Approval, Permit No. M-1977-219, Revision No. TR-1 <br />Dear Mr. Welte: <br />On September 14, 2010 the Division of Reclamation, Mining and Safety approved the Technical Revision application <br />submitted to the Division on August 18, 2010, addressing the following: <br />Remove the mining phases from the permit, limit the maximum affected acres to 25 acres and keep the maximum <br />lineal feet of expose high wall to the approved 1570 feet and keep the maximum high wall height to 25 feet. <br />The terms of the Technical Revision No. 1 approved by the Division are hereby incorporated into Permit No. M-1977- <br />219. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M-1977-219 <br />remain in full force and effect. <br />1) The operator will limit the maximum lineal feet of the high wall that will be exposed at any given time not to <br />exceed 1570 feet, with a maximum height of high wall not to exceed 25 feet. <br />2) Phased mining is removed through this revision.
