VI. Summary. <br />The Order that Cotter violated the Act should be reconsidered insofar as it is based on <br />findings of fact or conclusions of law involving the mine pool. The Board lacks statutory <br />authority to order mine dewatering and treatment in these circumstances. Even if the Board has <br />the authority to order mine dewatering and treatment, no such corrective action should be <br />ordered for the Schwartzwalder Mine, based on the grounds set forth above. Assuming there <br />were any justification for mine dewatering and treatment (which there is not), mine dewatering <br />and treatment could not be implemented through a technical revision.
