RN-06 <br />JACKSON COUNTY, COLORADO - PERMIT NO. C-80-006 <br />Dear Rob Zuber: <br />Kerr Coal Company's (Kerr) current mining permit (Permit No. C-80-006) is due <br />to expire March 20, 2011. This renewal request, No. RN-06, falls within the term of the <br />autumn years of the required Reclamation Liability Period for the Kerr Marr Mine and <br />Loadout site. The term of this renewal request is for 5 years, commencing March 21, <br />2011. As is documented, mining operations ceased in 1993 and following reclamation, <br />permanent seeding occurred in 1995 - 96 at the mine area and during 1999 - 2000 at <br />the Loadout site. Pond "F", located at the mine and adjacent to County Rd 12E was <br />approved to remain as a permanent structure. At the request of the BLM, a portion of <br />the road to the former Pond G (reclaimed) area was changed to permanent status to <br />serve as access to the BLM's property north of CR12E. During 2008, the remaining <br />water monitoring wells at the mine were sealed and reclaimed. The one overburden <br />well, formerly SP-01, was converted to a stock watering well at the request of the land <br />owner. <br />Having achieved successful reclamation requirements and established the <br />approved revegetation at the project, final bond release has been approved by the <br />Division on all but small areas at the mine and Loadout. During the reclamation period, <br />bond releases have been approved and are on file as SL-01, SL-02, SL-03 and SL-04. <br />The areas of exception (not released) are two 4 acre parcels (combined as 8 acres) at <br />the mine and 11.7 acres of the Loadout. These areas were not eligible for release until <br />2010 given that the permanent seeding/reseeding occurred during the year 2000. The <br />main entrance road at the mine (approximately 9 acres) was withheld from final bond <br />release so that the Division would continue to have access to the remaining unreleased <br />8 acres within the mine area. <br />The purpose of this renewal is to continue the few remaining reclamation tasks <br />as required per the approved permit document. Remaining reclamation tasks are such <br />as vegetation sampling and evaluation of the 8 acre areas at the mine and <br />sample/evaluation of the Loadout site as required for Year 10 of the reclamation liability <br />period. The small remaining pond located at the Loadout site, less than one acre in size, <br />is scheduled to be reclaimed by backfilling and reseeding with the approved permanent
