August 26, 2010 C- 1981- 008/New Horizon Mine MLT <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3); Drainage 4.03.1(4)/4.03.2(4); Surfacing and Maintenance 4.03.1(5) and <br />(6)/4.03.2(5) and (6); Reclamation 4.03.1(7)/4.03.2(7): <br />• WFC is preparing 5th Street Road to be opened to public travel. Right -of -way fencing has been <br />installed on the north and south sides of the road. They are coordinating with Montrose County <br />personnel in this process. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />• The second cutting of hay had occurred on several of the reclaimed fields. The hay on Benson -East <br />was windrowed, but not yet baled. <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />• At the Irrigated Pasture reference area, an area in the northwest corner had been plowed under (Photo <br />3). Mr. Fry explained that this was done in order to help mitigate a stand of Quackgrass that had <br />developed. Quackgrass is a weed found on Colorado's "List B ". <br />SPECIAL CATEGORIES OF MINING — Rules 4.22 through 4.27: <br />Prime Farmland (Rule 4.25) <br />• In accordance with the current agreement between WFC and the Division, there was no salvage, <br />handling, or replacement of prime farmland topsoil occurring at the time of the inspection. <br />• Beginning on August 16th, the shovel commenced excavation of the upper portion of the next strip of <br />Bench 1 overburden on the Morgan property (Photo 4). Rather than being dumped on the trailing <br />edge of the pit, the material was being stockpiled on Morgan property directly east of the pit.
