Inspection Report <br />Page 5 of 5 <br />to Little Deadwood Gulch and the La Plata River. The Division expects Wildcat Mining Corporation to <br />implement BMPs for cut slopes, to control water run-on to the slopes and to stabilize the disturbed slopes <br />itself to prevent erosion and the discharge of sediment from the disturbed slope area; for fill slopes, to <br />stabilize the slopes and for perimeter control (as appropriate) to prevent erosion and the discharge of <br />sediment from the disturbed slope area; and for disturbed areas within the site to prevent erosion and the <br />discharge of sediment from the site. All BMPs must be installed and maintained to function as intended. <br />b. May Day No. 2 (Level 2 site <br />It was noted during the inspection that BMPs were not implemented to prevent erosion and sediment transport from <br />disturbed areas associated with the site to Little Deadwood Gulch and the La Plata River. Specifically, BMPs were <br />not implemented to stabilize the berm created from material removed from the adit entrance area. The unstabilized <br />berm extends toward the access road from the adit entrance, and is located immediately adjacent to Little Deadwood <br />Gulch (see attached Dhotographs 6, 7, and 8). (See also photograph 1 in Attachment C [DRMS inspection report]). <br />Stormwater runoff from this site flows directly into adjacent Little Deadwood Gulch (State waters - tributary to the <br />La Plata River) or to the La Plata River (State waters). As a result, there was a potential for the transport of sediment <br />from the unstabilized berm to Little Deadwood Gulch and the La Plata River. The Division expects Wildcat Mining <br />Corporation to implement BMPs to prevent erosion and the discharge of sediment from the unstabilized berm <br />to Little Deadwood Gulch or to the La Plata River. <br />c. New portal at approximate location of historic "Chief' portal <br />It was noted during the inspection that BMPs were not implemented to prevent erosion and sediment transport from <br />disturbed areas associated with the historic "Chief' portal site to Little Deadwood Gulch and the La Plata River. <br />Specifically, BMPs were not implemented to stabilize the newly constructed access to the portal or the material <br />removed from the portal entrance area. Material generated from these activities was deposited adjacent to and in <br />Little Deadwood (see attached photographs 9, 10, and 11). (See also photographs 8, 9, 10, 13, and 14 in Attachment <br />C [DRMS inspection report]). <br />Also, BMPs were not implemented to stabilize the cut and fill slopes created from these activities. Specifically, <br />BMPs were not implemented to prevent run-on to the slopes, to stabilize the slopes, or to prevent the discharge of <br />sediment from the disturbed slopes to State waters; in addition, BMPs were not implemented for disturbed surfaces <br />within the site to stabilize the surfaces or prevent the discharge of sediment mobilized from site surfaces to State <br />waters. <br />Stormwater runoff from this site flows directly to adjacent Little Deadwood Gulch. (State waters - tributary to the La <br />Plata River). In addition to the material deposited directly in Little Deadwood Gulch, there was a potential for the <br />transport of sediment from the disturbed areas associated with the historic "Chief' portal site to Little Deadwood <br />Gulch, ultimately to the La Plata River. The Division expects Wildcat Mining Corporation to remove the <br />material deposited in Little Deadwood Gulch, and implement BMPs to prevent erosion and the discharge of <br />sediment from the access road and cut and fill slopes to Little Deadwood Gulch. Activities associated with this <br />removal must comply with all local, State and Federal regulations. In addition, the Division expects Wildcat <br />Mining Corporation to provide the date that it constructed the access road and portal.
