Improvement of existing access road to Chief portal and May Day No 3 (Lamb) (1.0 acres disturbed) <br />During the inspection, the inspector noted that the existing road used by Wildcat Mining Corporation to access the <br />Chief portal (not on map provided by W Incorporated) and May Day No. 3 (Lamb) had been improved. Specifically, <br />berms had been constructed along the perimeter of the access road; both the berms and the road surface were in an <br />erodible condition. This construction activity is contiguous and related to those documented in findings 2.a and 2.b <br />above; therefore, it is considered part of a common plan of development or sale. As determined from maps provided <br />by Rz Incorporated (see Attachment B), the area of this road disturbance was approximately 1.0 acres [(2800 ft x 16 <br />ft)/43,560 ftz]. <br />The disturbed improved road is steeply sloped-the road gains approximately 600 ft in elevation from the intersection <br />with the Level 1 access road to the Lamb facility (see Attachment B). Stormwater runoff from the disturbed road <br />flows downgradient along the path of the road or off the edge of the road to either Little Deadwood Gulch (State <br />waters and tributary to the La Plata River) or to the La Plata River (state waters). <br />3. It was noted during the inspection that BMPs were not implemented, or were inadequate, to manage stormwater runoff <br />from disturbed areas associated with the constructed roads and the disturbed, existing access roads at the facility. Specific <br />deficiencies and locations are identified below. <br />a. Road construction: It was noted during the inspection that BMPs were not implemented to prevent erosion and <br />sediment transport from disturbed road surfaces, to Little Deadwood Gulch and the La Plata River and wetlands <br />area located downgradient of the roads. Specifically, erosion control BMPs were not implemented to stabilize the <br />road surfaces, slow stormwater velocity down the road gradients, or shed stormwater from the road; sediment <br />control BMPs were not implemented to prevent the discharge of sediment mobilized from the road surfaces to <br />State waters. Specific locations identified during the inspection include: <br />i. New access road off County Road 12-at beginning of the switchback that directs the road along the La <br />Plata River (see attached photograph 1), and the upper portion of the road adjacent to the La Plata River <br />(see attached photographs 2 and 3). See also photograph 2a in Attachment C (SJBHD inspection report), <br />and photographs 1, 4 and 8 in Attachment D (DRMS inspection report); <br />ii. Disturbed access road to May Day Level 1-at the approach to the Level 1 facility (see attached <br />photographs 4 and 5); <br />iii. Disturbed access road to Chief portal and May Day Lamb-along the approach to the Chief portal and <br />the :May Day Lamb facilities (see attached photographs 6, 7, and 8). <br />As a result, there was a potential for the transport of sediment from the road surfaces to Little Deadwood Gulch <br />(State waters and tributary to the La Plata River) and the La Plata River and wetlands area located downgradient <br />of the roads (State waters). All roads must be designed and constructed in accordance with good <br />engineering practices, and must have adequate BMPs implemented such that the road sheds water (water <br />bars, crowning, gravel, or other erosion controls designed for use with roads). Unpaved roads must be <br />stabilized in such a way as to minimize erosion, rutting and sediment discharge, and rill or gully erosion <br />must be prevented. <br />b. Cut slopes and fill slopes: It was noted during the inspection that BMPs were not implemented, or were <br />inadequate, on cut slopes and fill slopes associated with the previously described access roads, to prevent erosion <br />and sediment transport from these slopes to Little Deadwood Gulch and the La Plata River and wetlands area. <br />Specifically, in many locations, BMPs were not implemented to prevent run-on to the slopes, to stabilize the <br />slopes, or to prevent the discharge of sediment from the disturbed slopes to State waters.
