Wildcat Mining Corporation: Idaho Mine and mill site
November 10, 2008
Note that the application requires the preparation of a Stormwater Management Plan (SWMP). A
guidance document on the SWMP preparation was provided at the time of inspection and has also been
enclosed.
If you fail to obtain the required stormwater permit and discharge stormwater from the site once
construction has started, you are in violation of the Clean Water Act and are subject to enforcement
action by the Water Quality Control Division. The Clean Water Act authorizes both civil and criminal
penalties for willful non-compliance.
This Compliance Advisory is intended to advise you of possible violations of the Colorado Water
Quality Control Act, it's implementing regulations and permits, so that you may take appropriate steps
to avoid or mitigate formal enforcement action. This Compliance Advisory does not constitute a Notice
of Violation or Cease and Desist Order and is not subject to appeal. However, the issuance of this
Compliance Advisory does not limit or preclude the Division from pursuing its enforcement options.
The Division is currently evaluating the facts and if a formal enforcement action is deemed necessary,
you may be issued a Notice of Violation / Cease and Desist Order that may include the assessment of
penalties.
If you have any questions, please call me at (970) 245-5702.
Sincerely,
Chad Engelhardt,
Environmental Protection Specialist
Enclosures
cc: Matt Czahor, Water Quality Control Division
Kate Pickford, Colorado Division of Reclamation, Mining and Safety
File Copy
ec: Victoria Schmidt, La Plata County
\\Envirosmcr\enviromental\Enviro\Programs\Stormwater\08-09 SW InspectionsUdaho Mine La Plata Canyon _CCE\081105 WMC_compliance_inspection.doc
