Re leacid 4 , <br />San Diego, California 82117 f end sa e y on <br />Subject: Mayday Road Project, La Plata County, Colorado <br />Dear Mr. Clements: <br />On August 5, 2010, I visited your project site as a response to the Colorado Department of <br />Mining Safety and Reclamation's (CDRMS) June 3, 2010 inspection report. During my site visit I <br />observed that the road is continuing to slide towards the wetland area. In response to this failure <br />you have installed temporary measures to prevent the further erosion of debris into waters of the <br />U. S. Nationwide Permit 14 requires you to maintain all permitted structures. To prevent further <br />failure of the road, you must implement a permanent control to prevent erosion and slumping. If <br />the road fails, causing a discharge of fill into waters of the U. S., you will be required to initiate <br />corrective measure, which may include full restoration of the wetland and stabilization or removal <br />of the road. <br />In addition, according to the CDRMS report additional fill material has been placed within <br />Little Deadwood Creek. As you are aware, the discharge of dredged or fill material into a waters of <br />the U. S., require a Department of the Army permit. According to our records a permit has not been <br />issued for this work. Therefore, you are in violation of Section 404 of the Clean Water Act. Please <br />contact this office within ten days of the receipt of this letter, identifying the reason for discharge <br />and the method you plan to take to resolve this violation. <br />Please refer to identification number SPK-2007-00980-DC in any correspondence <br />concerning this project.
