Pineda <br /> Director <br />Re: New Elk Mine (Permit No. C-1981-012) <br />Permit Revision Application No. 3 (PR-3) <br />Jansen Coal Loadout <br />Dear Las Animas County Commissioners: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on September 10, 2010, a permit revision application for a permit to <br />conduct coal mining operations, Permit No. C-1981-012 by New Elk Coal Company, LLC, was considered complete for the <br />purposes of filing. All review and comment periods as provided in the Colorado Surface Coal Mining Reclamation Act and the <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining initiate from this date of filing. <br />The applicant proposes to construct and operate a coal loadout facility at the Jansen rail yard located on the west side of <br />Trinidad. This ten acre area has been previously disturbed. The applicant is not proposing any new disturbance. Operations <br />are proposed to occur at the loadout until the rail spur is re-established to the New Elk Mine site 25 miles to the west. <br />The underground coal mining operation is located approximately 25 miles West of Trinidad, Colorado. The permit area is <br />further described as follows: <br />T33S, R68W, Portions of Sections 24, 25 and 26. All sections are partially or fully projected by New Elk Coal Company due to <br />the unsurveyed nature of the Maxwell Land Grant. The above-mentioned tracts of land are shown on the USGS 7.5 minute <br />Quadrangle maps of Vigil, Tercio, and Stonewall. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Trindad. <br />A copy of the revision application is available for public inspection at the Las Animas County Commissioners.
