The <br />expiration date has since past. <br />We request this NOI be reinstated with a new expiration date of June 1, 2011. Our intention is to <br />begin a new drilling program starting in October 2010 with a completion date no later than June <br />1, 2011. <br />There has been a slight adjustment in the locations of the intended holes. This adjustment should <br />have minimal effect on the extent of disturbance and total footage drilled. A map showing the <br />new locations in relation to the original locations is attached. <br />NOI X-2008-230-02 <br />On September 29, 2008 the Division provided a favorable determination pending two items: 1) <br />submission of a performance bond calculated at $46,476.00, and 2) proof of approval by the <br />Bureau of Land Management (Coal Exploration License COC-72922). These two pending items <br />are enclosed. <br />Due to the later than expected BLM approval and resulting budgetary restraints BME was not <br />able to undertake this exploration program until this time. We intend to initiate drilling starting <br />on or about October 4, 2010 and potentially continuing until June 1, 2011, concurrent with the <br />expiration of the BLM Coal Exploration License COC-72922.
