CO?o <br />? r <br />* /876 • <br />Colorado Department <br />of Public Health <br />and Environment <br />The Colorado Department of Public Health and Environment ("the Department"), Hazardous Materials <br />and Waste Management Division ("the Division") received correspondence from Adams County on <br />August 2, 2010. The correspondence included: (1) a memorandum from Adams County Planning and <br />Development Department dated July 28, 2010 requesting the Division's review of the subject <br />Certificate of Designation ("CD") application, and (2) a document entitled "Design and Operations <br />Plan, Inert Fill for Albert Frei and Sons, Inc., Frei-Henderson Property," dated June 30, 2010 ("the <br />DOP"), and prepared by Molen & Associates, LLC. The Division conducted a completeness review of <br />the DOP in accordance with procedures outlined in state statute, CRS §30-20-103 et seq., and <br />corresponding Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part 1 ("the <br />Solid Waste Regulations"). The Division finds the DOP to be substantially complete. <br />The Division will soon begin its comprehensive technical review of the DOP. The comprehensive <br />technical review is required by statute to be completed within 150 calendar days following the end of <br />the 30-day completeness review period (i.e., by January 28, 2011). During the 150-day technical <br />review period, the Division will publish a public notice seeking written comments on the DOP during a <br />30-day public comment period. The Division's final recommendation to Adams County on the CD <br />application will not be made until the Division has reviewed public comments that may be received. <br />For your information, please note that §30-20-104 of the Solid Waste Act states: <br />"(3)(a) Prior to the issuance of a certificate of designation, the governing body having jurisdiction <br />shall require that the report, which shall be submitted by the applicant under section 30-20-103, be <br />reviewed and a recommendation as to approval or disapproval be made by the Department and shall <br />be satisfied that the proposed solid wastes disposal site and facility conforms to the local government's
