Pineda <br />148 Cheyenne Court Director <br />Lyons, CO 80540 <br />RE: Colorado Rose Red Pit; DBMS File No. M-1978-332; Outstanding Corrective Actions <br />Dear Mr. Liesveld, <br />The Division of Reclamation, Mining and Safety (Division) conducted an inspection of the <br />Colorado Rose Red Pit on July 27, 2010. In the Division's inspection report dated August 6, <br />2010, the following problems were cited: <br />1. The Division does not have a record of a Reclamation Plan Map. <br />2. The Mining Plan Map has not been updated to reflect the changes in the Mining Plan. <br />3. The Mine Plan needs to be updated and clarified. <br />4. The Operator has failed to follow the approved Reclamation Plan. <br />The above listed problems were to be addressed through a Technical Revision, which was to be <br />submitted to the Division by August 31, 2010. During our conversation on August 31, 2010, you <br />indicated that you would like to increase the permit acreage to include the historic spill pile on <br />the south face of the mountain where mining is taking place. The Division will allow you to <br />address the above listed problems through an Amendment to the permit instead of the Technical <br />Revision. As noted above, the corrective action date for the cited problems was August 31, 2010. <br />Therefore, you will need to submit a request for an extension of the corrective action date. The <br />request shall be made in writing and shall specify the date by which the outstanding problems <br />will be resolved.
