As I stated in our phone conversation on August 9, 2010, that
hearing will be set for the Mined Land Reclamation Board's meeting on September 15, 2010.
The Division has also received Cotter's August 9, 2010 letter from John Hamrick to Tony
Waldron in which Cotter asks that the financial warranty amount be "reduced." To be clear,
because Cotter has not yet posted a financial warranty a request for a reduction of the
warranty is not relevant at this time. However, the Division would like to continue
discussions regarding an appropriate financial warranty amount. Tony Waldron will be in
contact with Cotter personnel.
Sincerely,
FOR THE ATTORNEY GENERAL

PETER HACK
Assistant Attorney General
Resource Conservation
Natural Resources
303-866-5049
(FAX)
Email: peter.hack@state.co.us
cc: Cheryl Linden, AGO
