NATURE OF VIOLATION.
This item is in regards to a Notice of a Possible Violation, corrective actions and civil penalties
for a possible violation of C.R.S. 34-32.5-109 (1) for failure to obtain from the Board or Office a
reclamation permit prior to engaging in a new mining operation.
CHRONOLOGY.-
July 29th, 2010 - The Division of Reclamation, Mining and Safety (Division) received a
complaint letter from Weld County, stating an unpermitted mining operation was taking place 3.5
miles southwest of Grover at the intersection of Weld County Road 81 and Weld County Road
120.
August 5th, 2010 - The Division and Weld County conducted a joint inspection of the Konig Pit
to determine if the activities taking place on the property required a Reclamation Permit. The
Division was unable to make contact with the landowner, Mr. Michael Konig, and therefore did
not enter the property. A significant amount of surface disturbance was observed from the road.
