("Cotter") received a data report from
Energy Laboratories which included results for a July 14, 2010 stream sampling event
conducted at monitoring station SW-BPL. Monthly monitoring and reporting requirements for
this "downstream" station are specified in paragraph 26 of the above referenced Notice of
Violation/Cease and Desist Order ("Paragraph 26"). Please find enclosed key excerpts of the
analytical data report that are specifically relevant to requirements of Paragraph 26, including
results for water samples collected on July 14, 2010 at sampling station SW-BPL.
Note that certain analytical parameters specified in the Order could not be analyzed and
reported for this sample (i.e., Gross Alpha, Gross Beta, Ra-226+228, and weak acid dissociable
Cyanide). It is expected that all parameters specified in the Order for "upstream" and
"downstream" locations (SW-AWD and SW-BPL), along with all other monitoring
requirements and schedules specified by the WQCD, DRMS, and the Radiation Management
Unit of the CDPHE, will be included in sampling results going forward.
Also, note that the "upstream" location (SW-AWD) was sampled on July 13, 2010 and was
thus submitted to the laboratory under separate chain of custody and sample submittal forms.
Those results were received earlier by Cotter and the results were submitted to WQCD on
August 19, 2010 under a separate cover letter. Those results were also subject to the
limitations as noted above.
Cotter Corporation Telephone (719) 275-7413
Canon City Mill, P.O.
