Z- September 2, 2010

ENERGY FUELS RESOURCES
CORPORATION
Colorado Division of Reclamation Mining & Safety
1313 Sherman Street, Room 215
Denver, CO 80203
CEIVED
SEP 0 3 x'010
UNY
Re: Annual Report for the Whirlwind Mine, Permit No. M-2007-044
To Whom It May Concern,
This letter serves as the annual report for the Whirlwind Mine, DRMS Permit No. M-
2007-044. A check for the annual fee in the amount of $1,150.00 was sent to your office
on August 25, 2010. Per Mary Rodriguez at DRMS, it is our understanding that this
check has been received and credited to our account. Attached with this letter is the
Annual Report Request Form and a map of the current site layout. The Whirlwind Mine
is currently operating in intermittent status. This was established with the Substitute for
Notice of Temporary Cessation, sent to your office on May 12, 2009 and approved with the
June 5, 2009 letter issued by DRMS. The total disturbance at the Whirlwind Mine site
stands at 12.03 acres, as reported in the previous annual report.
No new surface disturbance has occurred at the Whirlwind Mine site since the last annual
report sent to DRMS on September 8, 2009. During this period, maintenance activities,
such as noxious weed management, stormwater control maintenance and reseeding, have
been performed on the surface facilities. Mine water removal, treatment and discharge was
suspended as of December 2009 and mine water is being allowed to accumulate in the
mine workings. During the period of intermittent status, the mine has been maintained
with periodic site visits. Vegetation has been well established on the periphery areas of the
original surface disturbance areas, the fill and topsoil stockpiles, and the diversion
ditches. Temporary vegetation is moderately established in the waste rock expansion
area, although this area is not required to be vegetated at this time.
Energy Fuels has remained diligent in meeting environmental compliance requirements set
forth in various permits and approvals required for the mine. A list of the various permits
and approvals and a brief summary of Energy Fuels' efforts to remain in compliance with
them follows.
Mesa County Conditional Use Permit
Bi-annual weed surveys and pesticide application were performed at the mine and along
5110 Road and were reported to Mesa County and the BLM.
Monthly monitoring and an annual precise survey of sediment pond posts (to detect
ground subsidence) were performed. No subsidence was detected. A report summarizing
the monitoring and survey was sent to Mesa County and copied to DRMS.
Road maintenance was performed as needed.
Energy Fuels, Inc.
www.energyfue'ls.com
44 Union Blvd., Suite 600
Lakewood, Colorado 80228
Phone: 303-974-2140
Fax: 303-974-2141
