111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham and Dan Hernandez of the <br />Colorado Division of Reclamation, Mining, and Safety (Division). Al Weaver of New Elk Coal <br />Company represented the operator. All that remains within the small permit area are 1.2 <br />acres at the NW-1 ventilation shaft, seeded and mulched in late 2004. The gate to the gas <br />road remains locked where the entry signs are posted. Evidence of heavy storm runoff was <br />obvious at the gate, likely from recent storms within the past week or so. The weather was <br />clear and warm. Ground conditions were excellent. <br />Signs and Markers <br />The operator should repaint and/or replace, as necessary, disturbed area markers that are <br />found at the perimeter of the reclaimed area. The operator should ensure that included in <br />this marked area is the road ramp that was used during final reclamation of the ventilation <br />shaft. <br />Revegetation <br />The reclaimed ventilation facility pad area appeared in good condition, with no sign of <br />Erosional damage from recent storm runoff. The reclaimed pad otherwise appears <br />unchanged from last month's inspection. Nothing unusual or unexpected was observed. <br />The operator may want to consider a Phase 11 bond release for this small area. <br />
