August 30, 2010 <br />Mr. Jared Ebert <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M-1989-120 - Platte Valley Operation <br />May 13, 201 spection - Corrective Action Response <br />Dear Jared: <br /> <br />AGGREGATE <br />INDUSTRIES <br />CEY)fFED <br />46G 3 12010 <br />Dtvision of Reciafriati®n, <br />710 RMning and Sa Wl y <br />This letter and the enclosed are submitted in response to corrective actions required relative to <br />material imported to and backfilled at Aggregate Industries' (AI) Platte Valley site, as set forth in <br />your report on the Division's inspection conducted May 13, 2010. <br />Enclosed are copies of documentation provided to Aggregate Industries by Broda's Clean Fill <br />operation with regard to the types of material accepted for backfilling at AI's Platte Valley <br />Operation together with copies of the annual reports provided by Broda to Al indicating the <br />quantities of material imported and backfilled. Broda began accepting import fill material at the <br />site in 2008 and, according to the annual report dated January 15, 2009, took in 60,679 cy that <br />year. According to the January 15, 2010 annual report for 2009, 75,229 cy were imported and <br />backfilled. As noted in the 2009 report, two analytical tests were conducted in 2009, copies of <br />which are also enclosed. Per verbal communication with Broda this date, 43,418 cy of material <br />has been imported and backfilled in 2010, bringing the total material import and backfill quantity <br />to date to 179,326 cy. <br />As noted in your inspection report, Colorado Department of Public Health and Environment <br />(CDPHE) required that an analysis on drilling fluid/daylight mud be conducted by Broda to <br />determine if that material is inert, and the Division required that Al submit the results of such <br />analysis.
